How the Rules of the Game in the Real Estate Market Will Change to Protect Honest Buyers

Last week, a key meeting took place between representatives of the professional community and legislative authorities. The Vice President of the Russian Union of Real Estate Market Participants, Yulia Pletneva, met with State Duma Deputy Yaroslav Nilov. The main topic was legislative initiatives aimed at permanently eliminating one of the most acute and unfair problems from the market.
The meeting was constructive and marked an important step towards systemic changes. The parties agreed on support and close cooperation in promoting a package of bills that radically change the protection of the rights of bona fide home buyers.
The focus of the discussion was on initiatives introduced by Yaroslav Nilov, which close a monstrous legal loophole. Today, if a court declares a transaction invalid because the seller acted, for example, under deception or in a state of incapacity, the honest buyer suffers a double loss: they lose both the apartment and all the money invested. By that time, the funds are often spent, and there is no one to recover them from. As noted in the explanatory note to the bill, such a situation "is socially unjust, unacceptable, and requires urgent legislative response."
What is proposed? Legislators have prepared a balanced package:
Priority of money return. The court is obliged to set a deadline for returning the apartment to the seller only after confirming the full return of the entire amount to the buyer from the invalid transaction.
Registration level fixation. Rosreestr will not register the transfer of rights back to the seller without providing a document proving that the buyer has received their money back.
In simple terms: The new norm makes the financial fulfillment of obligations a condition for the return of real estate. This will radically reduce risks for ordinary buyers, especially for families investing all their savings in housing or taking out a mortgage.
"Supporting this package of bills is our collective contribution to improving the market and restoring justice," noted Yulia Pletneva following the meeting. "This is not just a legal amendment; it is a matter of basic trust of citizens in the safety of real estate transactions. The Union will actively participate in the examination and public discussion of these vital changes."
Yaroslav Nilov, in turn, emphasized the social significance of the initiatives and readiness for dialogue with the professional community to develop the most effective protection mechanisms.
What does this mean for the market? If the laws are adopted, the bona fide buyer will no longer be a hostage to circumstances. This will strengthen the legal purity of transactions and become a powerful tool against fraudulent schemes involving unscrupulous or incapacitated sellers.
